It may be that Visa, et al, have changed their *merchant agreements* to require certification in order to continue being a merchant. Or more likely, certification is required to enjoy Visa, et al's, coverage against CC theft. But unless you can cite a specific piece of legislation in the US, I'm going to just ignore everything else you say on the topic.
